TERMS OF SERVICE

 

 

You MUST read all the related info regarding the design or commission before purchase.

 

By purchasing my art services, you automatically agree to the following conditions.

Please read this entirely and carefully. If there are any questions or concerns please contact me.
 

I speak English and Spanish so if you want me to clarify something, just ask!

General Information:

​

• DO NOT alter or remove my watermark under any circumstance.

• Every rule abides by the other rules, meaning if I say it is okay to do something it is only okay to do if you follow the other rules.

• I post every commission I do to DeviantArt, my Wix site, Instagram, plus other places to promote myself. If you don’t want that, please tell me.

• I can use all of my artwork as a sample for sales/self-promotion, display and post it wherever I want, unless otherwise agreed upon. I retain all copyrights over my work, for commissions you are only paying for my artist labor. However, I’ll be respectful not to distribute or reproduce the artwork if it involves your characters (meaning commercially). The copyright conditions may vary from commission to commission, depending on what it is. COMMERCIAL USE is only permitted if you buy that license from me. For adoptables, I have the right to revoke the design if you don’t follow my rules. If you don’t want your commission publicly posted, I respect that so please tell me.

• The rights here, regarding the use of my artwork, apply to the commissioner/buyer ONLY, but the rules regarding my artwork apply to everyone (if you don’t understand or are not sure what this means, please ask me).

• If you think someone might be breaking these rules notifying is appreciated!

For Commissions

 

When commissioning me:

​

• Payment must be sent before I begin, unless I tell you otherwise. I usually send the invoice right before sending the commissioned piece, unless it is work that requires revisions. Please wait until I've accepted the commission before sending the payment.

  • This can be negotiated.

  • Notify me for any delay in the payment.

  • If you don’t I’ll take that as not paying, and not only will the design and art be revoked, you will be blacklisted and won’t be allowed to use the art or design in any way (selling, transferring, trading, etc).

• Provide clear references. If you’d like a custom, you need to communicate clearly what you want and provide images, inspiration, colors, etc. if possible or wanted.

• I have the right to decline a commission and do whatever I please with the sketch (if I did one).

• If your character belongs to a Closed Species (CS) the commissioner will be in charge of following the species' rules when commissioning, not me (the artist). I will not be held responsible.

• If you want something changed please tell me during the sketch or line art phase (preferably). If there is something I need to change after the sketching phase (depending on what it is if it is something large or small) I’ll charge. Be clear and concise in your description when requesting a change. You may use references and pictures.

• If you want to upload my art to another website, please ask first.

• You cannot use my artwork for commercial purposes. Personal use only unless we agree otherwise. Feel free to ask me about its intended use if you’re not sure if follows my rules.

• You can purchase Commercial Rights of an artwork.

• You can use the art to promote yourself with proper credit given to me, the artist, and linking back to my gallery.

• The time it takes me to complete a commission varies depending on:

The order of commission, complexity, school, family matters, health, etc.

• I’ll do my best to keep you updated if something happens.

For Adoptables

​

• You have to credit and tag me the first time you draw the character. Don’t claim my designs as your own.

• Do NOT trace, copy or steal my designs. If you buy one you may alter it however you want (please tell me if you alter it), but you must credit me for the original design. Don’t make a species off my designs. Don’t claim it as your own even if you altered it. You can’t change its species to a Closed, Open or Semi-Open species.

• Under no circumstances may you alter the original artwork created by me. However, you may alter the design as you see fit using your own work.

• Only claim or bid on a character if you can pay for them. You must pay within 48 hours or I’ll put it back up for sale. I will not give refunds.

• Notify me when you have paid and I will send you an unwatermarked version privately.

• If you sell, trade, gift the design you must notify me and show the new owner my Terms of Service. If you resell them it must be for the same price or lower. If it has extra art and you want to add the price of the extra art to the original price of the design, you need to have the permission of the artist of the artwork.

• Gifted or free designs can’t be sold, only gifted or traded.

 

The Purchase of Commercial Rights

If you purchase commercial rights:

• Credit is still needed even if you edit or alter my work.

• The cost of the commercial rights varies depending on the piece and the intended uses.

• You can make merchandise out of it.

• You can use it in books, covers, to alter it however you like, to promote your brand. Redistribute, reproduce, use for your project(s), as an ad, for a video, to resell at conventions, etc.

 

“Description Only” commissions

​

    A “description only” commission requires me to create a character and a scene with said character. If you want a commission like this, you have to ask me for the price because it will not only count as a regular commission but also a custom (preferably with at least one visual reference.). If you only want the character, not a scene, then it would count as a custom.
